Series Description  The Civil Court of Western Australia was established in 1832 to deal with all cases as did the Courts of Westminister in England. Suits were to be commenced in the Court by summons and not by arrest. Pleadings in the court were to be oral and made in person. In 1861 all powers of the Civil Court were transferred to the Supreme Court. The civil files date from the foundation of the Civil Court and continue with the transition to the Supreme Court. They include writs, summons, affidavits, warrants, orders and notices, recognizances, calendars, paper books etc. These various documents are filed together with other similar documents eg, writs with writs, affidavits with affidavits. Therefore papers relating to any one case may be filed at several numbers.

There are also papers relating to cases heard in equity (included in items 74-84), and to bankruptcy, divorce, ecclesiastical (probate and administration) and all the areas of civil law. Also included are notes and papers of Mr Justice Stone and his associates (items 93-115) relating to civil matters.

The most useful registers for locating the early civil files include the Records of Plaints (Record Series No. 129) for 1832-1861, Cause Books/Records of Judgement (Record Series No. 131) for 1861-1894, and Minute Books-Civil Court (Record Series No. 136) for 1832-1884.
